BNP Fake Membership List Issues

The attempt to try and damage the BNP with the release of an edited copy of the membership list which has been tampered with to include peoples names who are not BNP members, and which has also been tampered with to remove peoples names who are BNP members, is one of the most inept attempts of recent years to undermine the party morale.

For example I can state that Denise Garside of Lancaster Unity is a BNP member. That does not make that statement true.

I could create a BNP membership list that included the Pope, the entire government, Elvis and Norman Wisdom - but that does not mean that is a true membership list.

The membership list that has been put on the internet contains real BNP members, but also many non-BNP members whose names have been added maliciously.

For those people who have been named on the list all you need to do is deny you are a member if asked.

Your employer cannot ascertain whether you are actually a real member of the BNP, and we will confirm that you are not a member if you ask us, and therefore the whole farsical situation is a sad joke.

If required write to the BNP and we will confirm that you are not a BNP member.

Just because a dodgy list has been aired on the internet does not make it a legitimate list.

I once saw a photograph of Elvis serving Fish and Chips in a chippie in Huddersfield, but that did not make it a real picture of Elvis.

I once read a list on the internet where I was listed as the first man on the moon, and as far as I can recall at that time I was still in Nursery School.

Anyone who believes what they read on the internet on an anonymose blog is a complete sap.

The ONLY legitimate membership list is one held by the BNP and the pseudo-list put on the internet is simply a mixture of real membership details and false ones.

The false list of names included in this spurious document is because the entire document is a malicious construct designed to try and cause problems for innocent people - and therefore it has no worth in any way as an actual legitimate document.

Any employer who seeks to use the list in order to damage an employees rights is guilty of a breach of Section 55 of the Data Protection Act, which is a criminal offence.

Simply possessing a copy of the false membership list is a criminal offence, this is because some of the names on the list are real names and others are not.

The details in the document that are real are stolen details and therefore to possess any names and any copy of the list is to be in receipt of stolen property.

Any employer that sought to try and dismiss an employee on the grounds of an individual being named on the list is going to end up shelling out tens of thousands of pounds in compensation.

I have been working for a while on a legal argument re the Equality Act that incorporates European Union law, ECHR case law and various European Treaties regarding the right not to suffer political discrmination in the UK in the workplace.

I was most interested in the Hansard transcripts of the passge of the Bill for the Equality Act where various government functionaries sought to give assurances to various fascist Labourites in the House of Lords that the amended Religious Discrmination Regulations that encompassed 'Philosophical Belief' would not apply to political discrimination.

Unfortunately because of the ineptitude of the people in the House of Lords the people that passed the Equality Act did not take into account one important factor - that the The Employment Equality (Religion or Belief) Regulations 2003 were passed into law in order to give effect to a European Directive.

The EU Directive (2000/78/EC) of 27 November 2000 (known as the Framework Directive or the Employment Directive) established a general framework for equal treatment in employment and occupation. It provides for equal treatment in employment on grounds of religion or belief, sexual orientation, disability and age. Directives must be transposed into national law, and the UK complied with this requirement by making the Employment Equality (Religion or Belief) Regulations 2003 (SI 2003/1660), which came into force in Scotland, England and Wales in December 2003 (Northern Ireland having prohibited religious discrimination since 1989).

The various treaties stated in the preamble of the Directive state clearly that 'Belief', or ' Philosophical Belief' as enacted in UK law includes ' political belief'.

Therefore even though the UK law tries to limit the scope of the protection to a 'Philosophical Belief' the Directive states that political belief comes under the remit of the directive - therefore UK law has to be read as in accord with the rights given undert the directive.

Now any student of EU law will be able to tell you that Directives are requirements that member states change their national laws within a stated period of time in order to give effect to the directive. in the UK. Directives can be implemented either by statute or by delegated legisilation under the European Communities Act 1972, but any UK law that transposes a EU Directive must give effect in totality to the rights defined in the Directive.

Therefore the phrase ' Philosophical Belief' in the Equality Act must be read as to include ' Political Discrimination' as political discrimination is expressly defined in the treaties and legal sources of the Directive.

If anyone who has any problems at work as a result of this idiotic list then contact me and I will assist you in taking your employer to an Tribunal.

If any websites host a copy of this list then they are guilty of both a contempt of court and also a breach of Section 55 of the Data Protection Act 1998 - so let me know what web sites host the information and I will ensure the police are informed.

Part 2 of the Equality Act 2000 came into effect on 6 April 2007.

To reiterate - those that think that because something is published on the internet that it is a correct membership list are retarded.

The leftist idiots that think they have obtained a legitimate membership list are deluded.
